At LogTag®, the security and privacy of your data is of the highest priority.

We have developed this Privacy Policy (the “Privacy Policy” or the “Policy”) for you to understand how we collect, use, communicate, disclose and make use of personal information when you interact with one of our products, and the choices you have associated with that information.

LogTag North America Inc, in conjunction with its development entity LogTag International Ltd, ("us", "we", or "our") operate a number of websites and applications [the "Service(s)"], both free and paid, to which this Policy applies, including:

  • the company websites https://logtag.com and https://logtagrecorders.com
  • the LogTag® Online environmental monitoring system web application at https://logtagonline.com;
  • the LogTag® Online companion smartphone apps, available from the Apple or Google App stores ;
  • the company support website at https://logtagrecorders.zendesk.com;
  • the free companion software application LogTag Analyzer;
  • the free notification and reporting software application LogTag® Xpress; and
  • any other online services, applications, and webpages that post, specifically reference, and incorporate this Privacy Policy.

By using the Service, you agree to the collection and use of information in accordance with this Policy. Unless otherwise defined in this Privacy Policy, terms used in this Privacy Policy have the same meanings as in our Terms of Use, accessible from https://logtag.com, and which are incorporated herein.

ICM Holdco III Corp. (d/b/a CIMSENSE), a parent company of LogTag, its affiliates and its related entities (individually and collectively, “CIMSENSE,” “we,” “us,” or “our”) respect your privacy. We provide this website privacy policy (“Privacy Policy”) to describe how we collect, use, disclose, or otherwise process such data (including personal information) that we and our suppliers collect through our website (“Collected Information”) and our other websites on which this Privacy Policy is posted, on our mobile application(s) on which this Privacy Policy is posted, as well as the services made available through such websites (collectively referred to as the “Sites”). This Privacy Policy also describes your choices regarding the use of your Collected Information and how we communicate changes to this Privacy Policy. By accessing or using the Site, by accepting the Site’s Terms of Use or by entering into any other agreement with CIMSENSE that governs access to or use of the Site, you agree on behalf of yourself and any organization or company that you represent (together, “you”) that you have read and understand this Privacy Policy. If you do not agree with this Privacy Policy, do not access or use the Site. This Privacy Policy is incorporated into and made a part of our Terms of Use and any other agreement that references this Privacy Policy or that governs access to or use of the Site. CHANGES TO THIS PRIVACY POLICY

We reserve the right to update this Privacy Policy at any time. All updates will be effective immediately upon posting of the updated Privacy Policy on the Site. Material changes will be clearly posted on the Site or otherwise communicated to you.

INFORMATION YOU SUBMIT

Personal Information. You can visit the Site without submitting your personal information to us but you will be required to provide your personal information in order to sign up for an account on the Site (where that option is available), to order or purchase products or services using the Site (where that option is available), and to use certain other tools and features of the Site. We will collect any personal information from or about you that you choose to provide to us, which may include, without limitation, your first and last name, physical address, telephone number, email address, and payment information. To sign up for an account on the Site, where that option is available, you may be required or given the opportunity to provide additional types of information (as described below). Any such information that you choose to submit will be collected by CIMSENSE. We will use your personal information as described below in this Privacy Policy, including to set up and administer your account and to communicate with you. Phone Numbers. If you provide a mobile or other telephone number to us, you consent to receiving text messages and telephone calls from us at that telephone number as described below, but only to the extent permitted by applicable law. Registration and Logins. To sign up for an account, you must provide specific information, including without limitation, personal information, such as financial and payment information to facilitate purchase you make through the Site. Once you are registered (where that option is available), when you login to your account, we will collect your login username, password, and email address (if applicable). Order & Payment Information. We request information from you when you fill out an order form or otherwise purchase products or services through the Site. To purchase products or Services using the Site, where that option is available, you must provide your contact information (e.g., name and shipping address) and the applicable payment information. All purchases made using the Site must be made by credit or debit card, or under your existing account with us through a purchase order (if applicable) or other process as agreed to between CIMSENSE and you. CIMSENSE does not directly access, handle, or store credit or debit card information submitted through the Site. To make a purchase using the Site, you will need to provide your name and your credit or debit card type, number, expiration date, security code, and billing address. This information is used for billing purposes and to fill your orders. If we have trouble processing an order, we may use this information to contact. Job Applications. If you submit a resume, job application, or related materials or other information to us, we may use that information to evaluate your qualifications and consider or respond to your inquiry or application. Your submission of a resume, job application, or related information does not in any way require CIMSENSE to review that information or consider you for employment. To view career opportunities at CIMSENSE or to submit a job application, you may be redirected to an online career portal operated by a third party. We encourage you to review any terms and privacy policies posted on that portal (if applicable). Contact Form, Quotes, Requests for Support. To contact us for more information, quotes for our applicable products and services, or to request support via the Site, you will need to provide your contact information (as discussed above) as applicable, details of the products or services, the company you work for, and the subject matter in which you are interested. Connecting With Distributors. Some features on our Site may allow you to request a quote or request us to connect you with a distributor of a particular product. To fulfill such a request, we may need to disclose your contact information with the applicable distributor. By submitting such a request through the Site, you hereby direct us to disclose your contact information with the applicable distirbutor(s). Marketing Communications. If you sign up or otherwise opt in to receive blog updates, promotions, or other communications from us, you will need to provide your email address. We will use this information to send you CIMSENSE updates and promotional and other electronic communications. CIMSENSE will obtain your prior consent for such promotional communications solely to the extent required by applicable law. In order to provide you with a personalized experience, these communications may be tailored to your preferences based on, for example, inferences we make using your visits to the Site or the links you click on in our emails. Please note that pixel tags, cookies and other online trackers may be used within emails to track your interactions with those websites and when emails are opened. You may opt out of receiving updates and other emails from us at any time by following the unsubscribe instructions in the applicable email or by contacting us using the contact information provided below under “Contact Us.” Note that, even if you opt out of receiving promotional communications from CIMSENSE, you may still receive administrative communications from us with respect to your use of the Site. We may use third-party email providers to deliver these communications to you.

OTHER INFORMATION COLLECTED

As you navigate and use the Site, certain information can be passively collected—that is, gathered without the user actively providing the information or being concurrently made aware of the collection of information—using various technologies. We passively collect a variety of types of information in a variety of ways, including: IP Addresses and Related Data. The servers used to operate and provide the Site may collect data pertaining to you and the equipment, software, and communication methods you use to access the Internet and the Site, including Internet protocol (“IP”) addresses assigned to the computers and other devices from where you access the Internet, your Internet service provider (ISP), device ID numbers and unique identifiers, your media access control (MAC) address, your operating system, your computer screen resolution, your web browser type, the pages you access on the Site, the websites you access before and after visiting the Site, the length of time you spend on the Site, date and time stamps, clickstream data, your approximate geographic location, performance statistics, and usage data. CIMSENSE may use this information to administer the Site and its servers, to generate statistical information, to monitor and analyze Site traffic and usage patterns, to monitor and help prevent fraud, to investigate complaints and violations of our policies, and to improve the Site. We may combine this information with other Collected Information (including personal information) and information obtained from third parties for security reasons and to protect our rights or the rights of others. The suppliers that we use to provide the Site may collect information about your visits to the Site and other websites. Some of this information may be collected using cookies and similar tracking technologies as explained below under “Cookies and Tracking Technologies.” Analytics. The Site uses third-party analytics tools (e.g., Google Analytics) to collect and process data about your use of the Site, including when you visit the Site, URLs of the websites that you visit prior to visiting the Site and when you visit those websites, and IP addresses assigned to the devices from where you access the Internet. Our analytics providers may set and read cookies to collect this data and your web browser will automatically send data collected by those cookies to our analytics providers. Our analytics providers use this data to provide us with reports that we will use to improve the Site’s structure and content. For more information on how Google uses this data, visit Google’s Privacy Policy and Google’s page on How Google uses data when you use our partners' sites or apps. To prevent this data from being used by Google Analytics, follow the instructions to download and install the Google Analytics Opt-out Browser Add-on for each browser you use. Using the Google Analytics Opt-out Browser Add-on will not prevent CIMSENSE from using other analytics tools and will not prevent data from being sent to the Site itself or to Google. You may disable cookies as discussed below, but that may impact your use and enjoyment of the Site. Social Media. The Site may allow you to connect to and share information with social media platforms and we may be required to implement cookies, plug-ins, and APIs provided by those social media platforms in order to facilitate those communications and features. We may share information that you provide us or that we may collect about your use of the Site with those platforms and that information will be subject to their privacy policies. We encourage you to review the privacy policy of any social media platform that you use in connection with the Site. In addition, by choosing to use any third-party social media platform or choosing to share content or communications with any social media platform, you allow us to share information with the designated social media platform. We cannot control any policies or terms of such third party platform. As a result, we cannot be responsible for any use or disclosure of your information or content by third-party platforms, which you use at your own risk. CIMSENSE is active on social media. You may have the opportunity to comment on those social media platforms regarding CIMSENSE and the products we offer and/or to submit or upload related photographs and other materials. CIMSENSE reserves the right to post on the Site, other websites, and social media pages any comments, photographs, or content that you post on our social media pages or provide to us through social media. Cookies and Tracking Technologies. We use “cookies” on the Site. A cookie is a piece of data stored on a Site visitor’s hard drive by the visitor’s web browser. We use cookies to help us improve your access to the Site (for example, by remembering your contact and other information when you access or use the Site), to identify repeat visitors to the Site, to track how you access and use the Site, to learn when and how users visit the Site, to learn whether our Site and/or its pages are popular, to learn which search terms are used to find the Site, to learn which websites direct you to the Site, to help display certain information on the Site, and to improve your enjoyment of the Site. The Site may use both cookies that we implement, and cookies implemented by our suppliers and other third parties. “First-party” cookies allow your browser to talk to the actual website that you are visiting, whereas “third-party” cookies allow your browser to talk to third-party websites, such as the source of an ad that appears on the website you are visiting or a third-party analytics provider. Most browsers automatically accept cookies. Browsers generally also allow users to manage cookies in the browser’s settings. For example, a browser may allow you to reject cookies from certain websites, reject certain types of cookies regardless of the website, reject or disable all cookies from all websites, and/or delete cookies stored previously. Some browsers also give you the option of being notified every time a cookie is sent to your browser by a website. You can disable or limit cookies but doing so may impact your use and enjoyment of the Site and other websites. For example, the Site may not be able to be personalized for you, may no longer capture or remember your preferences or other choices you have made on the Site in the past, and may not remember your name or contact information. Changing your cookie preferences in one browser will not necessarily carry over to other browsers, so you may need to adjust your preferences each time you get a new computer, install a new browser, upgrade an existing browser, or alter or delete a browser’s cookie file. Our suppliers may use cookies and tracking technologies, such as pixel tags, to track Site visitors across the Internet to understand how you get to the Site and for the analytics purposes disclosed in this Privacy Policy. We do not have access or control over these cookies and this Privacy Policy does not cover the use of third-party cookies. The types of information collected by a cookie and the purposes for which that information is used depends on the type of cookie. By way of illustration, the types of cookies used, the types of information collected by those cookies, and the purposes for which that information are used are described below. We may combine information collected by cookies with other Collected Information.
  • Operationally necessary cookies (also called essential cookies). These are cookies that are required for the operation of the Site. For example, these cookies are required to identify irregular website behavior, prevent fraudulent activity, and improve security. They also allow users of the Site to make use of its functions. Without these cookies, features and services you have requested will not be able to be provided.
  • Functional cookies. These cookies allow us to offer you enhanced functionality when accessing or using the Site. This may include to remembering choices you make, for example, remembering your preferences or settings, remembering if you reacted to something on or through the Site so that you are not asked to react to it again, remembering if you have used any feature of the Site before, remembering your username or preferences, remembering if you have used any feature of the Site before, restricting the number of times you are shown a particular advertisement, and enabling social media components. If functional cookies are disabled, various functions of the Site may be unavailable to you or may not work the way you want them to.
  • Performance cookies (also called analytical cookies). These cookies assess the performance of the Site, including as part of our analytic practices to help us understand how visitors use and interact with the Site, for example, which pages on our websites users visit most often. These cookies also enable us to personalize content and remember your preferences. These cookies help us improve the way our websites work and provide a better, personalized user experience.
A cookie can either be a “session” cookie or a “persistent” cookie. Session cookies exist only for so long as you are visiting the applicable website. Session cookies are typically deleted or removed when you exit or quit your browser application. Persistent cookies exist for a set period of time, for example, six months or one year. Each time you visit a website that has implemented a persistent cookie, that cookie will remain active until its predetermined expiration date. You can also manually delete persistent cookies as discussed above. The Site may also use the following types of tracking technologies: web beacons (also called clear GIFs), flash cookies, and pixels (also called pixel tags). Web beacons are tiny graphics with unique identifiers that functions similar to how cookies function but, in contrast to cookies, web beacons are embedded invisibly on websites. Flash cookies collect and store information about your use of a website and are commonly used for advertisements and videos. Pixel tags can be placed on websites or within emails to track your interactions with those websites and when emails are opened. How We Respond to Do-Not-Track Signals. Due to the automatic collection of data using cookies as described above, we do not honor “do not track” requests. For this reason, your selection of the “Do Not Track” option provided by your browser may not have any effect on our collection of information using cookies and other tracking technologies. Embedded Content. The Site incorporates content, including feeds, scripts embedded in the Site’s code, and visible content (e.g., videos), provided by third parties. In some cases, those third parties collect data about how you interact with their content. For example, Google Maps or YouTube. Google Maps. Our Sites may include Google Maps features and content. Google Maps features and content is subject to the then-current versions of Google Maps/Google Earth Additional Terms of Service at https://maps.google.com/help/terms_maps.html and Google Privacy Policy at https://www.google.com/policies/privacy/. YouTube. Our Sites may use YouTube to make content in video format available to you. By accessing a part of the Sites where videos are available, watching an embedded video, or otherwise interacting with any content made available through YouTube, you signify your agreement with YouTube’s terms and conditions. YouTube collects and otherwise has access to usage data (e.g., what videos you accessed and watched) through videos embedded in the Services as further described in YouTube’s Privacy Policy. YouTube adheres to Google's privacy policies and principles, part of which allow you to control certain privacy settings and which data are collected. For more information, please visit https://www.youtube.com/howyoutubeworks/user-settings/privacy/. Information from Other Sources. We may obtain data about Site users from various third-party companies and public sources, whether offline or online (such as publicly available social media profiles), and we may combine that data with Collected Information. This enhances our existing information about our users and customers and improves our ability to contact you and our marketing’s relevancy. In addition to the categories described above, when you use the LogTag Link mobile application we collect certain Bluetooth interaction data and precise location information as described below.

Bluetooth and Precise Location Data Collected by LogTag Link Mobile App

The LogTag Link mobile application (LogTag Link) uses Bluetooth Low Energy (BLE) technology to discover, identify, and communicate with nearby compatible LogTag and supported IoT devices. When you use Bluetooth scanning and device download functionality, we may collect:
  • Device serial numbers and broadcast identifiers;
  • Bluetooth signal strength (RSSI) and connection metadata;
  • Download timestamps;
  • Device configuration and telemetry data necessary for product functionality; and
  • Operational logs relating to scan and download events.
This information is collected solely to enable device discovery, secure communication, authentication, configuration, data download, diagnostics, and related operational functions of the LogTag Link app. Bluetooth data is not used for advertising, behavioral profiling, or cross-application tracking. LogTag Link also collects your device's precise geographic location (GPS coordinates) when you use the app to scan for and download data from compatible devices. Precise location data is used to:
  • Associate device download events with a physical location;
  • Support traceability, auditability, and compliance recordkeeping;
  • Support legitimate business analytics relating to device deployment and usage.
Location data is collected only while the app is in active use and interacting with compatible devices. The app does not use precise location data for advertising purposes and does not sell location data. If background location permissions are not enabled, the app does not collect location data when it is not actively in use. The app requests Bluetooth and precise location permissions in accordance with your mobile device's operating system requirements. Precise location data is collected only after you grant the relevant permissions on your device. By enabling location permissions, you consent to the collection and processing of your precise location data for the purposes described in this Privacy Policy. You may withdraw consent at any time by disabling location permissions in your device settings; however, doing so may limit certain functionality of the LogTag Link app. Associated precise location information is stored as part of the device download record and retained only for as long as necessary to provide core application functionality, maintain traceability and compliance records, fulfill contractual obligations, comply with applicable legal or regulatory requirements, resolve disputes, and enforce agreements. We do not sell precise location data. Precise location data may be shared only with service providers listed in this Privacy Policy, including location and mapping providers such as HERE Technologies and mapbox, who process data on our behalf to support geocoding or mapping functionality, and with regulatory authorities, auditors, or law enforcement where required by applicable law. Bluetooth interaction data may be shared only with service providers who process data on our behalf to support hosting, infrastructure, security, analytics, and related operational functions of the app. All such service providers are contractually required to process personal data in accordance with applicable data protection laws. Bluetooth interaction data and precise location information are protected using the safeguards described in the ACCURACY AND SECURITY section of this Privacy Policy.

HOW WE USE AND SHARE COLLECTED INFORMATION

In addition to, and consistent with, the uses and sharing described above, CIMSENSE and its suppliers may use and disclose Collected Information as described below:
Personal Information We collect the following subcategories of personal information: We collect such personal information for the following purposes:
Identifiers Consistent with and in addition to the information set forth in the “Information You Submit” section above: First and last name, telephone number, cellphone number, email address. Performing services for you, providing customer services, verifying user information, facilitating access to services or products, processing payments. To administer your account. Communicating with you when you have requested support, information, services, etc. To send promotional communications about us, to the extent permitted by applicable law.
Internet or other electronic network activity information Consistent with and in addition to the “Other Information Collected” section above: IP addresses, log files, login information, and cookies and device information (e.g., online activity such as date and time of accessing our websites, website addresses accessed, the length of website visit). Analytical purposes, including, without limitation, to help us improve your access to the Site (for example, by remembering your contact and other information when you access or use the Site), to identify repeat visitors to the Site, to track how you access and use the Site, to learn when and how users visit the Site, to learn how popular Site pages are and aren’t, to learn which search terms are used to find the Site, to learn which websites direct you to the Site, to help display certain information on the Site, and to improve your enjoyment of the Site. To administer the Site and its servers, to generate statistical information, to monitor and analyze Site traffic and usage patterns, to monitor and help prevent fraud, to investigate complaints and violations of our policies, and to improve the Site. To administer your account.
Geolocation Precise geographic location (GPS coordinates) collected through the LogTag Link mobile application. As well as in LogTag Online, physical address; work / business address; state; region. Purpose: To associate device download events with a physical location, support traceability and compliance recordkeeping, enable operational reporting, communicate with you, and fulfill service requests.
Professional or employment-related information Business contact information, including, but not limited to, job title, place of employment, business phone number, business address. Performing the services or providing products, including, without limitation, providing customer services, verifying user information, facilitating access to the Site, processing payments. Communicating with users who have requested support, information, or services. To send you promotional communications about us and our products and services, to the extent permitted by law. To administer your account.
In addition to and consistent with the purposes identified above, CIMSENSE and our suppliers may use or disclose Collected Information for the following purposes:
  • Sharing with our Service Providers. We may disclose Collected Information to our suppliers and service providers as necessary for us to provide the Site and our products and services to you, to engage in the use and sharing of Collected Information as permitted by this Privacy Policy, and as may be otherwise required or permitted by applicable law. These third parties include, without limitation, our affiliates and related entities, website and software management and hosting suppliers, support service providers, third party payment processors, cloud storage providers, information technology security providers, marketing and public relations service providers, and email service suppliers.
  • Text Messages. If you opt in to receiving text messages (including SMS) on the Site when prompted, we may send you text messages at the number you provide for marketing purposes and communications. You can opt out of the receipt of such communications by texting us STOP at the number you received such message from. If you opt out of receiving marketing communications from us, please note that we may still send you messages to your physical address, email, or via text messages regarding your account, or for any Services you have requested or received from us (e.g., to notify you about the status of a purchase that you have made with us). Message and data rates may apply.
  • Data Aggregation. To the extent permitted by applicable law, we may aggregate personal information, user-generated content, and other Collected Information and use that aggregate data for our business purposes.
  • Lawful Processes, Security & Protection of Rights. We may use and share Collected Information as required or permitted in accordance with subpoenas, court orders, valid law enforcement requests, governmental agency requests, and other legal processes. We may use Collected Information if we believe doing so is necessary or appropriate to protect our rights or the rights of others.
  • Business Transactions. If CIMSENSE undergoes a change in control, acquisition, merger, reorganization, or asset sale (in whole or in part), we may transfer, sell, share, or otherwise disclose Collected Information to the subsequent owner(s) or successor(s) of those transactions. We may also disclose Collected Information in connection with the evaluation of those transactions.
  • With Your Consent. With your consent, we may use and share your personal information and other Collected Information in ways not specifically described in this Privacy Policy.
Disclosures to Third Parties. Pursuant to and consistent with the purposes for collecting your information as set forth in this Privacy Policy we disclose certain categories of personal information to third parties for a business (or other) purpose. The categories of personal information we disclose include:
  • Identifiers: including but not limited to name, telephone number, address, age, email address, or date of birth;
  • Commercial Information: including but not limited to financial account information, payment card information, your employer, and your billing information;
  • Internet or other electronic network activity information: including but not limited to computer and connection information, IP address, and cookies and other tracking technologies described further above; and
  • Inferences: drawn from the above categories of personal information.
As described in this Privacy Policy above, applicable business purposes for such disclosures include, without limitation, product and service fulfillment, internal operations, prevention of fraud and other harm, and legal compliance. The categories of third parties to which we may share the above categories of information, include, without limitation:
  • Our affiliates and related entities;
  • Third party service providers: including, but not limited to, payment processing companies, data analytics providers, fraud prevention providers, cloud storage providers, IT service providers, delivery partners, and marketing companies; and
  • Law Enforcement

AUTOMATED PROCESSING

Other than as described in this Privacy Policy, you will not be subject to decisions based on automated information processing without your prior consent.

RETENTION

CIMSENSE will retain personal information for as long as it is needed for or otherwise serves the purposes outlined in this Privacy Policy, subject to applicable law. Further, personal information is retained in accordance with our policies and practices, applicable law, and contractual obligations. Personal information collected for the purposes related to the performance of a contract or agreement between you and CIMSENSE will be retained until such contract or agreement has been fully performed. We may be required to retain personal information for a longer period of time where required to do so under applicable law or government order.

CHOICES AND RIGHTS

The purpose of this section of the Privacy Policy is to inform you of our privacy options. Some U.S. states and other jurisdictions outside of the U.S. provide these options and rights to their residents. Depending on the laws applicable to CIMSENSE’s processing of your personal information and the location in which you reside, you may have the ability to exercise the rights listed below and in this section of the Privacy Policy. Subject to foregoing, in addition to all application limitations, exemptions, or exceptions—regarding our collection and use of your personal information—these rights may include, to the extent applicable:
  • Right to Confirm: The right to confirm whether we are processing your personal information.
  • Right to Access: You may have the right to request access to any of your personal information that we hold. Specifically, you may have the right to request the disclosure of (1) what personal information has been collected; (2) the categories of sources from which the personal information was collected; (3) the business or commercial purpose for collecting or selling personal information; (4) the categories of personal information sold and to what third parties it was sold to (if applicable); (5) the categories of third parties with whom we share personal information and to what third parties it was shared with; and (5) the specific pieces of personal information we have collected about you.
  • Right to Data Portability: You may have the right to receive all such personal information about you from CIMSENSE in a structured, commonly used and machine-readable format, and also to require us to transmit it to another entity where this is technically feasible.
  • Right to Deletion: You may have the right to request the deletion of your personal information that we have collected.
  • Right to Correction: You may have the right to request the correction of your personal information that we collected.
  • Right to Lodge a Complaint: You may have the right to lodge a complaint with a government regulator (e.g., your state attorney general) or supervisory authority, in particular in your country of residence, if you consider that the collection and use of your personal information violates this Privacy Policy or applicable law.
  • Right to Not be Discriminated Against: You may have the right to not be discriminated against due to your exercise of your rights under applicable law. We do not discriminate against users for exercising the rights granted to them under applicable law and that are applicable to our processing of your personal information.

Sensitive Personal Information. In limited circumstances, including through the LogTag Link mobile application, we may collect precise geolocation data when you use Bluetooth scanning and device download functionality. Such data is collected only for the operational purposes described in this Privacy Policy and is not used for advertising or cross-context behavioral profiling. No Cross Contextual Behavioral Advertising; No Profiling Cross-Contextual Behavioral Advertising. We do not share your personal information for purposes of cross-contextual behavioral (targeted) advertising. We do not use your personal information to profile you via purely automated means in furtherance of decisions that produce legal or significantly similar effects (as may be defined under applicable law). Selling and Sharing. We do not sell your personal information as the concept of “selling” is traditionally understood as being the exchange of something for money. However, we do provide your personal information to our affiliates and subsidiaries, which may be differently branded, so they can provide you with marketing and information about services and products that may be helpful or of interest to you. Applicable U.S. state data protection laws hold such disclosures and sharing to be considered “selling”. Therefore, you have the right to opt out of such selling. ACCURACY AND SECURITY

Personal information you provide to us should be relevant to the purposes for which it is to be used, and, to the extent necessary for those purposes, should be accurate, complete, and up to date. We have in place reasonable and appropriate technical, physical, and organizational procedures and security measures designed to safeguard and secure personal information from unauthorized loss, alteration, access, disclosure, and processing, taking into account the cost of implementing such measures commensurate with the risks posed by the particular type of processing, the nature of the personal information, and in accordance with applicable law. We value your trust in providing us your information; however, no method of transmission over the Internet, or method of electronic storage is 100% secure and reliable. We cannot guarantee the security of Collected Information. We limit access to our systems that hold personal information to authorized personnel and such access is limited to those personnel who have a need to know such information for the purpose of performing their job function or as otherwise permitted under this Privacy Policy.

CHILDREN

The Site is not directed at children under 16 years of age. CIMSENSE does not knowingly collect or use information from children under 16 through the Site.

CROSS-BORDER TRANSFER

Due to the fact our business is international, we have centralized elements of our business and our processing of Collected Information, including, without limitation, personal information. Accordingly, where we are permitted to do so under applicable law, we may transfer your personal information outside of the nation where you reside. We may collect information about your PC, operating system, regional settings, installed browsers and other installed software if you specifically request help from us diagnosing problems with our Service, and improving the Service delivery.

Usage Data

We may also collect information how the Service is accessed and used ("Usage Data"). This Usage Data may include information such as your computer's Internet Protocol address (e.g., IP address), browser type, browser version, the pages of our Service that you visit, the time and date of your visit, the time spent on those pages, unique device identifiers and other diagnostic data.

The Services incorporate content, including, (for example), feeds, scripts embedded in the Services’ code, and visible content (e.g., videos), provided by third parties. Transfer of Data

LogTag North America Inc is a multi-national company and its online data are stored in several locations throughout the world. You agree that we may store Data (including any personal information) in secure servers in one or more overseas territories outside of New Zealand and we may access such Data (including any personal information) from time to time regardless of where such Data is stored.

Your information, including Personal Data, may be transferred to — and maintained on — computers located outside of your state, province, country, or other governmental jurisdiction where the data protection laws may differ from those within your jurisdiction.

Your consent to this Privacy Policy followed by your submission of such information represents your agreement to that transfer.

LogTag North America Inc will take all steps reasonably necessary to ensure that your data is treated securely and will process your data in accordance with this Privacy Policy. No transfer of your Personal Data will take place to an organization or a country unless LogTag North America Inc reasonably determines there are adequate controls in place including the security of your data and other personal information.

Disclosure of Data

We do not sell any Personal Data collected from you to any third parties.

At our discretion, we may disclose your contact data to one of our distributors for the purposes of providing support, only if you approached us via one of our sales or support Services. We will not use this contact information for any purpose other than the resolution of your specific inquiry.

We may also provide your Personal Data, including payment information, to our third party payment processor for purposes of facilitating purchases in connection with the Services.

From time to time, we may be asked by Government Institutes and associated Research Facilities to provide data for the purposes of independent analysis. Where we make such data available we will:

  • clearly identify circumstances in which such data may be provided to affected clients;
  • clearly identify which data will be provided;
  • remove any personally identifiable information, where possible, from such data; and
  • enable you to opt out of such a data collection.

Device Data

Data you collect with our devices is freely available to anyone who has access to the device, or to a computer that holds the device's collected data. It is your responsibility to take appropriate measures to protect such data where required. We will assist with your efforts to protect the data by making mechanisms available to you that prevent unauthorized access, however, employing those mechanisms is your responsibility. Specifically, we will:

  • make a password protection mechanism available for our loggers that prevents unauthorized re-configuration or data access; and
  • provide registration for devices into LogTag Online, ensuring only authorized personnel are able to view the data.

If you connect the device to LogTag Online, the data will be available to other LogTag Online users to whom you have granted permission to access the data.

Legal Requirements

LogTag North America Inc may disclose your Personal Data in the good faith belief that such action is necessary:

  • to comply with a legal obligation;
  • to protect and defend the rights or property of LogTag North America Inc;
  • to prevent or investigate possible wrongdoing in connection with the Service;
  • to protect the personal safety of users of the Service or the public; or

Retention of Data

Any information disclosed online can potentially be collected and used by parties other than the intended recipient. Service Providers

We employ third-party companies and individuals to facilitate our Service ("Service Providers"), to provide the Service on our behalf, to enhance the user experience of our Service, to perform Service-related services or to assist us in analyzing how our Service is used.

These third-parties have access to your Personal Data only to perform these tasks on our behalf and are obligated not to disclose or use it for any other purpose.

Microsoft

Microsoft provides the database and server technology for our online service LogTag Online via its Azure platform. You can find the respective privacy policy by following this link: https://azure.microsoft.com/en-us/overview/trusted-cloud/privacy/.

Twilio, WhatsApp and email-to-SMS providers

We use third party provider Twilio to deliver Email and Text messages in relation to our Services. For some clients, we also offer the use of WhatsApp as a convenient replacement for text messaging. In the US, users can select carrier provided email-to-SMS gateways in the account setup.

For Twilio, WhatsApp and the carrier provided email-to-SMS gateways to effectively manage these Services, we must pass certain information to them, including phone numbers, email addresses the contents of the messages to be passed on to the final destination and other potentially Personally Identifiable Information. Although our Third-party partners have an obligation under our agreement with them, once we have handed over this information, we can no longer control how the data is used beyond its intended purpose, and it falls within the individual provider's policies. Apple App Store and Google Play

Parts of our Service are delivered to you via App stores for iOS and Android devices. To make use of these Apps, you must have an account with the App provider and agree to the App provider's privacy policy and terms and conditions. PagerDuty

We allow you to send email messages via PagerDuty, a message and notification aggregation service. These messages are delivered to a PagerDuty account you nominate, and to which you are authorized to send data. Although no personal data is transferred to PagerDuty, data that forms the messages includes, but is not limited to, information about your location. Once sent, we can no longer control how the data is used beyond its intended purpose, and it falls within the individual provider's policies. Stripe

Our LogTag® Online Service allows members of your team with administration privileges to purchase authorization codes using a credit card. LogTag North America uses Stripe, Inc ("Stripe"), a financial services and 'software as a service (SaaS)' company to provide this functionality to you. To link a purchase transaction to your user account, LogTag North America must store a unique identifier that links your team name to Stripe's user ID. This identifier is generated the first time you invoke the Payment Portal via the Service and is permanently linked to your user account.

Although the user experience appears seamless, all financial transactions are completely conducted inside the Stripe Payment Portal. Payment data related to financial transactions is not stored by us, although the result of the transaction is processed by the Service, including, but not limited to, the date of the transaction and what you purchased. For example, we cannot see any credit card details, but will be able to determine the number of activation codes you purchased, when you purchased them and what they were allocated to.

Although we constantly monitor Stripe's performance as a Payment Services Provider, the financial transactions are solely the responsibility of Stripe, Inc., and any personal information you provide to Stripe is governed by Stripe's Privacy Statement and Terms & Conditions, which you can access on their website at https://stripe.com/privacy.

We have disabled the option to save credit card information in the Stripe Payment Portal, as this would allow other users, to whom you have granted access to your team, to purchase authorization codes on your behalf.

If you do not agree to the terms published by Stripe, Inc, please do not use credit card payments to purchase authorization codes.

mapbox

Our third-party provider mapbox, Inc. delivers maps for our geo-location feature. When you use the geo-location feature of LogTag Online in combination with the mapping feature provided by mapbox, mapbox collects certain data regarding the location of your device so an accurate map can be displayed in your browser. In order to provide this functionality, mapbox collects data identifying your logger and its location, as well as personal data, including, but not limited to, data about your IP address, your browser and your computer's operating system. Once you use the mapbox feature, and allow mapbox to collect this data, this data becomes subject to mapbox’s privacy practices and associated policies, and you acknowledge and agree that we do not control how the data is used by mapbox. If you do not agree to the terms published by mapbox, Inc, please do not activate the mapping feature in our service.

HERE Technologies

Our third-party provider, HERE Technologies, powers some of the location search and geocoding features within our service. When you use these features, certain information, such as the addresses or place names you enter, it may be sent to HERE's servers so that relevant location results can be returned and displayed. To provide this functionality, HERE may collect metadata associated with your use of the location feature. This includes, but is not limited to, your search queries. Once you use the HERE-powered feature, the data is also subject to HERE Technologies' own privacy practices and policies. You acknowledge and agree that we do not control how HERE Technologies uses or stores this data. If you do not agree to the terms published by HERE Technologies, please refrain from using the location-based features within our service.

YouTube

We use YouTube to make content in video format available as part of our help delivery system. By accessing a part of the Services where videos are available, watching an embedded video, or otherwise interacting with any content made available through YouTube, you signify your agreement with YouTube’s terms and conditions. YouTube collects and otherwise has access to usage data (e.g., what videos you accessed and watched) through videos embedded in the Services as further described in YouTube’s Privacy Policy. YouTube adheres to Google's privacy policies and principles, part of which allow you to control certain privacy settings and which data are collected. If you do not agree to the terms published by YouTube, please do not use any portion of the Services that makes video content available, or click on or interact with the embedded video content.

Other third-party Data

You may ask us to store credentials for accessing third-party services on your computer. We use these credentials to allow you to seamlessly transfer data generated by our services to third-party service information storage and communication providers. In general, the third-party providers used by us will only collect and use your information to the extent necessary to allow them to perform the services they provide to us. We still recommend you read their respective privacy policies. Third-party services include, but are not limited to the following:

  • Connection to online services such as SMTP servers, FTP servers or proxy servers
  • Security certificates for the purposes of connecting to SFTP servers
  • API credentials (OAuth2) for connection to Gmail (you can find Google's privacy policy on their website at https://policies.google.com/privacy)
  • Wireless network access details and passwords (in encrypted form) for your local network
  • Cellular service providers and their respective email-to-text services
  • App store providers

We will only store those data if you or an authorized representative of yours have explicitly requested their use. Where such data are not already encrypted, we will encrypt them before storing them. You will be able to revoke the use of such data by simply removing the affected data, or by withdrawing your permission directly with the third-party service. LogTag North America Inc will take all reasonable steps to make sure no data are stored once you have explicitly deleted them from the Service.

LogTag North America Inc will never use such stored data for any purposes other than specifically agreed to when setting up the service. LogTag North America Inc will also never share such information other than detailed in "Transfer of Data".

Analytics

You acknowledge and agree that:

  • we may use Data and information about your use of the Service to generate anonymized and aggregated statistical and analytical data ("Analytical Data”), and use such Analytical Data for our internal research and product development purposes and to conduct statistical analysis and identify trends and insights;
  • we may use third-party Service Providers to monitor and analyze the use of our Service;
  • our rights under this clause will survive termination of expiry of the Agreement; and
  • title to, and all Intellectual Property Rights in, Analytical Data is and remains our property.

You acknowledge and agree that, to the extent Data contains personal information, in collecting, holding and processing that information through the Service, we are acting as your agent for the purposes of the Privacy Act 1993 and any other applicable privacy Law. You must obtain all necessary consents from the relevant individual(s) to enable us to collect, use, hold and process that information in accordance with these Terms.

Google Analytics

Google Analytics is a web analytics service offered by Google that tracks and reports website traffic. Google uses the data collected to track and monitor the use of our Service. This data is shared with other Google services. Google may use the collected data to contextualize and personalize the ads of its own advertising network.
