Limited Warranty
LogTag North America Inc ("The Company", "Us") warrants that your Data Logger, when purchased from an authorized LogTag North America Inc distributor, will be free from defects in materials and workmanship for a period of one (1) year ("Warranty Period") on delivery from our warehouse. This limited warranty is applicable only to the original purchaser ("Customer") who purchased the product from an authorized distributor and is non-transferable.
Warranty Coverage
During the Warranty Period, if your Data Logger is found to have defects in materials or workmanship, LogTag North America Inc will, at its sole discretion, repair or replace the product, or provide a refund. However, please note that any compensation provided is limited to the cost of the Data Logger. Any repaired or replaced product will be covered for the remainder of the original Warranty Period.
Exclusions
This warranty does not cover:
- Normal wear and tear or cosmetic damage that does not affect product functionality;
- Damage caused by accidents, misuse, negligence, or improper handling;
- Unauthorized modifications or repairs;
- Any third-party accessories or components used with the product; or
- Batteries included with the product.
Making a Warranty Claim
To make a warranty claim, the Customer must:
- Contact the authorized LogTag North America Inc distributor from whom the product was purchased for instructions on initiating a warranty claim;
- Provide proof of purchase from the distributor (e.g., distributor's order confirmation, receipt, or invoice); and
- Follow the distributor's instructions for returning the product.
Disclaimer of Other Warranties
EXCEPT FOR THE EXPRESS LIMITED WARRANTY PROVIDED HEREIN, LogTag North America Inc DISCLAIMS ALL OTHER WARRANTIES, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY AND FITNESS FOR A PARTICULAR PURPOSE. TO THE EXTENT THAT APPLICABLE LAW DOES NOT ALLOW DISCLAIMERS OF IMPLIED WARRANTIES, THE DURATION OF ANY SUCH WARRANTIES WILL BE LIMITED TO THE DURATION OF THE EXPRESS WARRANTY PROVIDED HEREIN.
Limitation of Liability
LogTag North America Inc SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, CONSEQUENTIAL, SPECIAL, OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS OR REVENUE, REGARDLESS OF WHETHER SUCH DAMAGES ARISE FROM CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR OTHERWISE, EVEN IF LogTag North America Inc HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
Law and jurisdiction
These Warranty Terms, and any dispute relating to these Terms, are governed by and must be interpreted in accordance with the laws of New Zealand. Each party submits to the non-exclusive jurisdiction of the Courts of New Zealand in relation to any dispute connected with these Terms or the Service.
Changes to these Terms
We may update these Terms from time to time. We will notify you of any changes by posting a prominent notice on the Service's website. Unless we say otherwise, the changes become effective from the date published at the top of this document. We will also make a list of changes available, so you can easily assess the impact these changes have on you.
You are responsible for ensuring you are familiar with the latest Terms. By purchasing out product after the new "effective date" you agree to be bound by the changed Terms.
